We start testing potential approaches early, often in presuit, so discovery can be shaped by what jury-eligible citizens tell us is the best approach, rather than committing to a strategy and hoping for the best. The reason Hollywood puts out so many duds despite extensive focus grouping is that they test finished movies. At that point, fundamental structural changes cannot be made—the footage is shot, the actors are paid, the set is torn down. At best, superficial changes are all that are possible. If the underlying structure is unappealing, however, these changes are unlikely to impact the outcome.
