Mike Peters complained of headaches, depression, and TMJ disorder stemming from his October 1996 MVA. This exhibit gets right to the point. Medical records clearly show his first two maladies to be pre-existing. Furthermore, his lack of commitment to Dr. Jones' treatment (he missed more appointments than he made) contradicts his claim of constant TMJ pain.
This exhibit convincingly demonstrated the defense argument that Mr. Peters was not permanently injured as a result of this accident.
