Favorable Resolution for a Worker’s Compensation Carrier in Broward County, Florida

Best Evidence conducted four Roundtables for a worker’s compensation carrier in a worker’s compensation case in Broward County, Florida. The plaintiff claimed to have been injured while working for his long-term employer (a construction company). Plaintiff alleged that the worker’s compensation carrier wrongfully denied him medical testing thereby causing him to suffer irreversible paralyzing injuries. Moreover, the plaintiff claimed that the carrier intentionally inflicted emotional distress upon him by denying said medical tests. The defendant carrier denied any wrongdoing stating that it had good reason to question whether the medical tests were related to the plaintiff’s work accident. The plaintiffs sought nearly $70 million in compensatory damages, including the wife’s loss of consortium claim. Additional punitive damages were also being pursued. This case was favorably settled prior to trial.
